Vietnam Social Insurance Reform 2024/2025: Key Regulatory Changes Every Foreign Worker and FDI Employer Must Know
How Vietnam's new Social Insurance Law (Law No. 41/2024/QH15) updates contribution bases, reference salary rules, and lump-sum withdrawal eligibility for expatriates.

Vietnam has officially enacted the amended Law on Social Insurance (Law No. 41/2024/QH15, passed on June 29, 2024, taking effect July 1, 2025). This represents the most comprehensive reform of the nation's social security framework in a decade.
For multinational corporations, FDI business owners, and foreign personnel working under local labor contracts, this reform brings pivotal updates that demand proactive preparation.
1. Abolition of "Base Salary" in Favor of "Reference Level" (Mức tham chiếu)
Previously, the maximum contribution salary was fixed at 20 times the statutory "base salary" (lương cơ sở). Under the new law, this concept transitions to the "Reference Level" (Mức tham chiếu).
The reference level will be determined annually by the Vietnamese Government based on economic growth, consumer price index (CPI), and national budget capacities, ensuring that benefit calculations and contribution caps reflect actual economic conditions.
2. Crucial Protection: Lump-Sum Withdrawal Rights for Foreigners Remain Guaranteed
While public debates focused extensively on restrictions for Vietnamese domestic workers withdrawing one-time pensions, the amended law continues to explicitly safeguard the rights of foreign employees.
Foreign citizens working in Vietnam who terminate their labor contracts, have their work permits or practicing certificates expired, or permanently exit Vietnam maintain their statutory right to claim their full one-time lump-sum withdrawal immediately upon contract completion.
You do not have to wait 12 months after resignation. As soon as your work permit is cancelled and your employment contract is formally closed, your file can be submitted immediately.
3. Expansion of Bilateral Social Security Treaties
Following the groundbreaking Vietnam - South Korea Bilateral Social Security Agreement, Vietnam is actively negotiating and preparing reciprocal frameworks with key trade partners including Japan, Germany, and the European Union.
These frameworks prevent dual taxation on foreign assignments and enable period totalization for international pensions, creating greater flexibility for global talent mobility.
Action Plan for FDI Human Resources & Expatriates
- Review offboarding checklists: Ensure that foreign employees exiting in 2025-2026 receive their closed physical insurance book (Sổ BHXH) promptly upon labor contract termination.
- Audit VssID digital records: Verify that monthly contributions match the revised reference caps without missing periods.
- Prepare authorization early: If the expatriate cannot remain in Vietnam for the 10-15 business day statutory processing window, complete the notarized Power of Attorney before flight departure to eliminate overseas consular legalization costs.
