Survivorship & Funeral Benefits: The Overlooked Safety Net for Foreign Families in Vietnam
How Vietnam statutory social insurance protects overseas families and legal heirs of foreign professionals in the event of an untimely tragedy.

While most conversations around Vietnam Social Insurance (BHXH) center on the one-time lump-sum withdrawal upon exit, few international workers realize that mandatory contributions also incorporate a vital financial safeguard: Survivorship and Funeral Allowances (Chế độ Tử tuất).
If a foreign professional holding an active social insurance record tragically passes away while working in Vietnam, their overseas family members (spouse, children, or elderly parents) possess full legal entitlement to statutory bereavement benefits from the Vietnamese government.
1. One-Time Funeral Allowance (Trợ cấp Mai táng)
Under Article 66 of the Law on Social Insurance, if an insured foreign employee dies after having contributed to social insurance for at least 12 months, the person or entity organizing their funeral is entitled to a one-off statutory funeral allowance.
This allowance is legally pegged at 10 times the statutory reference salary (or base salary) in effect at the time of passing. At current levels, this represents an immediate lump-sum disbursement of approximately 23.4 million VND (~$950 USD) dedicated to bereavement logistics.
2. Lump-Sum Survivorship Benefit (Trợ cấp Tuất một lần)
In addition to the funeral grant, the legal heirs of the deceased foreign worker are entitled to the Lump-Sum Survivorship Benefit. The payout is calculated systematically based on the historical contribution years of the foreign worker:
- For contribution periods prior to 2014: 1.5 months of average contribution salary per year.
- For contribution periods from 2014 onwards: 2.0 months of average contribution salary per year.
- The minimum payout cannot be lower than 3 months of the average contribution salary.
For C-suite executives, senior engineers, and international school directors who contributed at the statutory salary ceiling over 3 to 5 years, this survivorship settlement routinely exceeds $15,000 to $30,000 USD.
3. Cross-Border Succession & Claim Execution
For overseas families grieving abroad, navigating the Vietnamese social security administration while managing consular documentation can feel daunting. Claiming the survivorship payout requires:
- Certified Death Certificate with consular legalization.
- Notarized heirship declaration or probate certificate proving kinship (marriage license, birth certificates).
- A consularized Power of Attorney (PoA) appointing a specialized local proxy in Vietnam to submit the dossier and remit funds to the overseas beneficiary.
