Digital Nomads & Remote Tech Contractors: The Employer of Record (EOR) Blindspot

Digital Nomads & Remote Tech Contractors: The Employer of Record (EOR) Blindspot

"I work remotely for a fintech startup in London. Vietnamese social security has nothing to do with me."

A software engineer in Thao Dien told me this over coffee last week.

He had lived in Saigon for three years, coding from cafes and coworking spaces, happily collecting his salary via an Employer of Record (EOR) platform.

Then I asked him to pull up his detailed monthly payslip breakdown.

Right there, under statutory deductions, was a line item labeled: "BHXH / Social Insurance: 8%"

His company had also been contributing 17.5% on top of that every single month.

Over 36 months, more than $14,000 in mandatory contributions had been deposited under his name into the Vietnamese state treasury.

He had no idea.

Here is the legal reality behind the modern remote work boom in Vietnam:

To work legally in Vietnam without doing stressful visa runs every 90 days, foreign tech professionals, product designers, and growth leads usually get sponsored through EOR providers like Deel, Remote, or local payroll agencies.

These platforms hire you on a compliant local labor contract to issue your Work Permit and Temporary Residence Card (TRC).

The moment that contract is signed, Vietnamese labor law kicks in.

Compulsory social insurance is mandatory.

You cannot opt out. Your employer cannot waive it.

The money gets deducted automatically from your compensation package and remitted to the state pension fund.

And here is where the blindspot turns into real financial loss:

When your project ends, or when you decide to pack your MacBook and relocate to Bali, Tokyo, or back to Europe:

  • Your EOR platform terminates your local contract and closes your digital dashboard.
  • They hand you your final payout and wish you safe travels.
  • Almost none of these global platforms will guide you through the offline, Vietnamese-language bureaucracy required to withdraw your accumulated social insurance lump sum.

Why? Because processing a lump-sum claim requires physical counter visits, manual dossier submissions, and liaising with district authorities. A global SaaS app isn't built for that.

So the remote worker boards their flight, assuming the deducted money was just a cost of doing business in Southeast Asia.

It isn't a sunk cost. It is your earned liquidity.

Under Decree 143/2018/ND-CP, foreign employees are fully entitled to a 100% lump-sum cash refund when their local contract ends and they depart Vietnam.

If you worked in Vietnam through an EOR or local entity for two to four years, you likely have between $6,000 and $20,000 waiting to be unlocked.
