Bilateral Social Security Treaties: What Korean & Japanese Executives in Vietnam Must Know

Understanding the Vietnam-Korea and Japan frameworks: dispatched Certificate of Coverage vs direct local employment contracts.

Bilateral Social Security Treaties: What Korean & Japanese Executives in Vietnam Must Know

South Korea and Vietnam made history with their Bilateral Social Security Agreement taking effect in 2024. Similar bilateral frameworks are advancing with Japan.

Yet in the industrial corridors of Bac Ninh, Binh Duong, and Dong Nai, confusion among Asian leadership teams is at an all-time high.

Almost every week, a Korean factory director or Japanese general manager asks me:

"Since the bilateral agreement is active, does that mean my Vietnamese social insurance is locked into a pension, or can I still withdraw my lump-sum cash refund?"

The answer depends entirely on one detail: how your contract is legally structured in Vietnam.

Here is the straightforward breakdown every foreign director from Seoul or Tokyo needs to know:

CASE 1: The Intra-Corporate Transferee (Phái cử nội bộ)

If your parent corporation in Seoul or Tokyo officially dispatched you to Vietnam, and your company secured an official Certificate of Coverage (CoC) from Korea's National Pension Service (NPS) or the Japan Pension Service:

  • You remain under your home country pension system.
  • You are exempt from compulsory Vietnamese retirement fund contributions for up to 60 months (5 years).
  • You do not pay Vietnamese pension deductions, and therefore do not have a lump sum to claim upon exit.

CASE 2: The Local Employment Contract (Ký HĐLĐ trực tiếp)

This is where the vast majority of senior foreign managers actually sit.

To comply with local business licensing and direct legal representation rules, many Korean and Japanese leaders are signed under direct local labor contracts with the Vietnamese subsidiary.

If your monthly payslips show statutory deductions and you do not hold an active Certificate of Coverage:

  • You have been contributing 8% of your capped salary every month, backed by 17.5% from your enterprise.
  • The bilateral treaty does not prevent you from claiming your money.
  • Under Decree 143/2018/ND-CP, the moment your assignment ends and your work permit lapses, you are 100% legally entitled to a full lump-sum cash refund.

For a director completing a standard 3-year term, that refund typically sits between $12,000 and $25,000 in clean, tax-free capital.

THE CULTURAL HURDLE

In Korean and Japanese corporate cultures, discussing personal state reimbursements often feels uncomfortable.

Directors frequently tell me: "I don't want to create extra administrative headaches for our local Vietnamese HR team."

So when the farewell party ends, the executive boards their flight to Incheon or Haneda, leaving thousands of dollars behind in the state fund out of corporate modesty.

You don't need to burden your internal staff.

Through an authorized legal proxy, the entire claim is handled confidentially outside your company office:

  • Zero administrative burden on your local factory HR.
  • No language friction at municipal government counters.
  • Funds wired directly into your designated account in Seoul, Tokyo, or Vietnam.
